Arbitration and Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted in Michigan, or at your election, by telephone or videoconference.
You and DogBreederLicensing.org each waive the right to a jury trial and the right to participate in a class action lawsuit or class-wide arbitration.
Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
This arbitration agreement is governed by the Federal Arbitration Act (9 U.S.C. § 1 et seq.) and evidences a transaction in interstate commerce. The FAA governs the interpretation and enforcement of this arbitration provision, notwithstanding any choice of law provision in these Terms.
If any part of this arbitration agreement is found unenforceable, the remainder will continue in full force and effect.
Governing Law
These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict of law provisions. To the extent any dispute is not subject to arbitration under the section above, you consent to the exclusive jurisdiction of the state and federal courts located in Michigan.
Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
Changes to These Terms
We may update these Terms from time to time. Continued use of the Site after any changes constitutes your acceptance of the new Terms. The effective date at the top of this page will reflect the date of the most recent update.
